Section 1 – Eligibility & Website Use
By using this site, you represent that:

- You will not use our products for any illegal or unauthorized purpose.
- You will not transmit any worms, viruses, or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
Section 2 – Custom & Made-to-Order Products
Note: 1Up Retro Clothing specializes in custom-made apparel. Every product is printed and sewn individually based on your specific requirements.
- We do not maintain ready-made inventory; every item is created specifically for your order.
- Once an order enters the production phase, modifications or cancellations are not permitted.
- Customer Responsibility: You are solely responsible for the accuracy of uploaded designs, sizes selected, and shipping information provided.
Section 3 – Product Accuracy & Variations
We strive to display our products’ colors and images as accurately as possible. However:
- Screen settings and display technology vary; we cannot guarantee your monitor’s display of any color will be 100% accurate.
- Slight variations in print placement and color saturation are inherent to the sublimation printing process and shall not be considered manufacturing defects.
Section 4 – Pricing & Payment Security
- Prices for our products are subject to change without notice.
- We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we will notify you via the email provided.
- Payments are processed securely through third-party providers (e.g., Stripe, PayPal). We do not store your full financial data.
Section 5 – Returns & Replacements
As per our Custom-Made Policy, returns are not accepted for change of mind or incorrect size choice. We provide free replacements ONLY for:
- Manufacturing defects (e.g., torn fabric, seam failure).
- Printing errors caused by our production team.

Section 6 – User Content & Intellectual Property
When you submit designs or images, you guarantee that you own the rights to such content. You grant us a limited license to use the content solely for the purpose of fulfilling your order.
All materials on this site, including branding, website code, and curated designs, are the property of 1Up Retro Clothing and are protected by US and International copyright laws.
Section 7 – Limitation of Liability
1Up Retro Clothing and our parent company, We Can Custom LLC, shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind arising from your use of any of the service or any products procured using the service.

These Terms of Use and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of California, USA.
