2. Eligibility and Acceptable Use
You must be at least 18 years old to make a purchase, or have the authorization of a parent or legal guardian. You agree to use the site only for lawful purposes and in a manner that does not interfere with the site’s security, availability, or other users’ access. You may not attempt to access restricted systems, introduce malicious code, use automated tools in a disruptive manner, or misuse the site for fraud or unlawful activity.
3. Intellectual Property
Unless otherwise stated, the site and its content—including text, product copy, photographs, graphics, logos, artwork, and design elements—are owned by or licensed to 1Up Retro Clothing and protected by applicable intellectual-property laws. We offer vintage, pre-loved, modern, and, where available, personalized or made-to-order products. We aim to present product images, sizing information, condition notes, colors, and descriptions accurately. However, screen settings can affect color display, sizing may vary by garment or era, and vintage or one-of-a-kind items can have normal signs of age, wear, fading, repair, patina, or minor variation.
Reasonably disclosed characteristics of a vintage or pre-loved item are not defects. Please review each listing carefully and contact us before purchase if you need additional condition, measurement, or customization information. Product availability is not guaranteed, and an item may be removed or become unavailable at any time.
5. Pricing and Order Acceptance
Prices are displayed in U.S. Dollars unless checkout states otherwise. We may change prices, promotions, and availability without notice. We make reasonable efforts to keep listings accurate, but pricing, inventory, typographical, or technical errors may occur. If an error affects an order, we may correct it, contact you, cancel the order, or issue a refund as appropriate.
Submitting an order is an offer to purchase. An order confirmation acknowledges that we received your order; it does not mean that we have accepted it. We may refuse, limit, or cancel an order for lawful reasons, including inventory unavailability, suspected fraud, payment authorization failure, inaccurate information, or an error in price or listing details.

To the extent liability cannot be excluded, our total liability for a claim related to an order will not exceed the amount you paid to us for the product giving rise to that claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
